Preface
In accordance with the provisions of Decree-Law No. 24/2014, of February 14, and Law No. 94/96, of July 31, this document establishes the terms and conditions to be observed in the use of the website www.marizdesign.pt as well as in the process of purchasing the products sold there, made available to its users.
Therefore, users of the website should carefully read the terms and conditions and privacy policy before using it, since by using it or placing an order, users are consenting to being bound by these conditions.
In case of disagreement with these terms and conditions and privacy policy, users should not use the website www.marizdesign.pt.
These conditions may be changed freely and without prior notice in order to adapt them to applicable legislation. As such, it is the responsibility of users to periodically review the Privacy Policy and General Terms and Conditions, as the provisions in force on the date of use of the website and the conclusion of the contract (as defined herein) will apply.
These general terms and conditions of sale are agreed between Mariz Design Unip, Lda, with registered office at Avenida Dr. Sá Carneiro loja 97, 4890-236 Britelo, Celorico de Basto, with a share capital of €1000, registered at the Celorico de Basto Commercial Registry under NIPC 518471411, and any user wishing to make a purchase through the website www.marizdesign.pt.
1º Order
1º The user may place an order through the website www.marizdesign.pt by filling in all the mandatory fields and providing their personal data. By doing so, the user expresses their full and complete acceptance of the general terms and conditions of sale, the prices, and the characteristics of the products included in the order. All orders are subject to acceptance by Mariz Design Unip, Lda.
2º Orders are subject to stock availability. The unavailability of the ordered products, or any other reason for the impossibility of fulfilling the order, will be communicated by Mariz Design Unip, Lda to the user. In this case, Mariz Design Unip, Lda will reimburse the user for any amounts paid, as provided for in Article 19 of Decree-Law No. 24/2014, of February 14.
3º Mariz Design Unip, Lda reserves the right to remove any product from the website www.marizdesign.pt at any time, as well as to delete or change any material or content, and is not liable for such action to the user or any third party, nor for the unavailability of the product, under the terms referred to in clause 2 of this article.
2º Order Execution
1º After confirmation of full payment for the products as well as shipping costs, and without prejudice to the provisions of clauses 2 and 3 of article 1, the order will be completed within a maximum period of 40 days.
3º Shipping Costs
1º Delivery of orders to the user’s home, or to an address indicated by them for this purpose, will imply the obligation for the user to bear the delivery costs, depending on the value of the products ordered and depending on the area.
4º Price and Payment
1º In accordance with current legislation, the prices established on the website www.marizdesign.pt are in euros, including taxes and duties, on the date of issue of the corresponding invoice.
2º The applicable VAT rate will be the one in force in the Member State of the place of delivery, according to the orders placed.
3º Prices and specifications are subject to change without prior notice.
4º Mariz Design Unip, Lda declines any responsibility for any errors published on the website www.marizdesign.pt.
5º If the actual price of the ordered product is higher than that shown on the website, the user will be contacted to accept or cancel the order.
6º If the actual price of the ordered product is lower than that shown on the Mariz Design Unip, Lda website, the difference between the actual value and the value paid will be refunded to the user.
5º Transfer of risks
The risks of the product will be the responsibility of the user from the moment of delivery.
6º Right of Withdrawal and Return
1º The user may withdraw from the order, indicating a valid reason, within 14 days from the date of delivery of the product, with a refund of the amount paid.
2º The shipping and return costs are the responsibility of the user. Thus, and in the case of cash on delivery, Mariz Design Unip, Lda may charge the user for the expenses it may incur.
3º The right of withdrawal may be exercised by the user in any way permitted by law, and shall be considered validly exercised by sending the withdrawal information.
4º This provision does not affect other rights granted to consumers by current legislation.
5º The right of withdrawal applies exclusively to products that can be returned in the same condition in which the user received them, especially in the original packaging and with all documents.
6º After the return, Mariz Design Unip, Lda will examine the products and verify their condition. If the products have been used beyond simply opening the packaging, or if they show damage, no refund will be made.
7º The user is entirely responsible for any damage suffered by the products or for their loss during the return process.
7º Defective Products
1º If, at the time of delivery, the user considers that the product does not conform to the order’s terms, they must contact Mariz Design Unip, Lda immediately.
2º The collection of the product that does not conform to the contract conditions will be carried out by Mariz Design Unip, Lda, which will examine the product and, if non-conformity is confirmed, will notify the user via email of the product replacement within a reasonable time.
3º The product replacement will, however, be subject to stock availability.
4º If replacement is impossible, the amount paid for the products will be refunded to the user, including delivery costs.
8º Refund of payments
Refunds, in cases of exercising the right of withdrawal and defective products, will be made using the same payment method used.
9º Exchanges
Products purchased on the website www.marizdesign.pt cannot be exchanged.
10º Right of withdrawal
The user has the right to withdraw from this contract within 14 calendar days, without needing to state any reason.
The deadline for exercising the right of withdrawal expires 14 days from the day following the day the contract was concluded.
In order to exercise your right of withdrawal, you must notify us at Mariz Design unip, lda, Avenida Dr. Sá Carneiro loja 97, 4890-236 Britelo, Celorico de Basto or by telephone +351 927 787 903 (Call to the national mobile network) or by email to geral@marizdesign.pt of your decision to withdraw from the contract by means of an unequivocal statement by registered letter sent by post or to the email address provided.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
11º Effects of free resolution
In case of termination of this contract, all payments made under it will be refunded to the user, including delivery costs (except for supplementary costs resulting from the choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and, in any case, no later than 14 days from the date on which we are informed of your decision to terminate this contract. Refunds will be made using the same means of payment used in the initial transaction, unless expressly agreed otherwise by the user; in any case, the user will not incur any costs as a consequence of such refund.
The refund may be withheld until we have received the returned goods, or until the user provides proof of shipment of the goods, whichever occurs first.
In situations where the contract involves the delivery of goods to users:
In case of contract termination, the goods will be collected by Mariz Design unip, lda – (if you opt for collection of the goods), either without undue delay and no later than 14 days from the day on which the user informs us of their decision to terminate the contract. The deadline is considered met if the user returns the goods before the end of the 14-day period.
The costs of returning the goods will be borne by the user.
The user is only responsible for any diminished value of the goods resulting from handling that exceeds what is necessary to establish the nature, characteristics and functioning of the goods.
12º Liability
1º For all stages of access to the website www.marizdesign.pt as well as the ordering, delivery and subsequent services process, Mariz Design Unip, Lda only has an obligation of means.
2º Mariz Design Unip, Lda does not guarantee or assume responsibility for any inconvenience or damage inherent to the use of the internet network, service interruption, external intrusion, the presence of computer viruses, or any other case of force majeure.
3º The products will be described and presented on the website www.marizdesign.pt with the greatest possible accuracy. If, nevertheless, errors occur on the website www.marizdesign.pt, Mariz Design Unip, Lda. is not responsible for such fact.
4º The provisions herein do not affect the rights granted to users regarding withdrawal from the contract.
13º Processing of personal data
1º The information or data provided by users will be processed in accordance with the provisions of the Privacy Policy.
2º By using the website www.marizdesign.pt, the user consents to the processing of the information and data referred to in the preceding paragraph and declares that all the information provided is true and corresponds to reality.
3º Personal data will be used by Mariz Design Unip, Lda. for information, dissemination and order processing purposes.
4º The user is guaranteed the right to access, rectify, modify or delete their personal data, simply by sending an email to geral@marizdesign.pt.
5º Notwithstanding that Mariz Design Unip Lda. collects and processes data securely and prevents loss or manipulation, using the most advanced techniques for this purpose, we inform you that collection on an open network allows the circulation of personal data without security conditions, running the risk of being viewed and used by unauthorized third parties.
14º Viruses, hacking and other computer attacks
Mariz Design Unip, Inc. is not responsible for any damages or losses resulting from a denial-of-service attack, virus or any other technologically harmful or damaging program or material that may affect the user’s computer, computer equipment, electronics, data or materials, as a result of using the website www.marizdesign.pt or downloading content from it or from the content to which it redirects.
15º Intellectual Property
1º All elements, sound or visual, of the website www.marizdesign.pt, including the underlying technology, are protected by copyright, trademarks or patents.
2º Users who have a personal website and wish to place a simple direct link to the page www.marizdesign.pt on their website for personal use must request prior authorization from Mariz Design Unip, Lda. Authorization is only valid if provided in writing.
3º Any link or hypertext directed to the website www.marizdesign.pt, using framing or in-line linking techniques, is strictly prohibited.
4º In all cases, the use of any link, including those referred to in points 2 and 3 of this article, even if authorized, must be removed upon simple request from Mariz Design Unip, Lda.
16º Entire Agreement
These general terms and conditions of sale constitute the entire agreement between Mariz Design Unip, Lda and the user. If any clause of these conditions becomes null or void due to legislative or regulatory changes or a court ruling, it will be considered unwritten.
17º Unilateral Amendment of these Conditions
1º These conditions may be amended at any time. The user is subject to the policies and conditions in force at the time they are using the website www.marizdesign.pt or placing their order, except when, by law or decision of government bodies, changes are made retroactively.
2º In the case provided for in the second part of the previous paragraph, the changes will also affect orders that the user has placed under the conditions subject to change.
18º Applicable Law and Jurisdiction
These terms and conditions are governed by Portuguese law. Any dispute arising from these terms and conditions shall be submitted to the competent Portuguese court.
19º Alternative Dispute Resolution
In the event of a consumer dispute, the consumer may resort to a Consumer Dispute Resolution Entity.
